The company Adentech s.r.o., with its registered office at Lindnerova 1610/4, Libeň, 180 00 Prague 8, IČO: 05444233 (hereinafter referred to as the “Adentech company”), pays great attention to the protection of personal data. In this document you will find information about what personal data we process about you as users, whether we process data on the basis of consent or on the basis of another legal reason, for what purposes we use it, to whom we may pass it and what you have in connection with the processing of your personal data. right.
1) Identification of the personal data controller
At Adentech, we determine for what purpose and by what means your personal data will be processed, ie in particular collected, recorded, sorted and possibly made available. At the same time, we are responsible for the proper execution of such processing of your personal data.
This role follows from our position as a controller of personal data, as we operate an online dating application available on the portal www.hledamsponzora.cz (hereinafter referred to as the "application"), thus exercising control over the processing of your personal data.
2) What personal data do we process?
It is important for us to know how and for what purposes we process your personal data. In the following section, we will show you what personal data is involved, including examples. We will then refer to the personal data categories below in other sections of this document.
a) Contact details
In particular, e-mail and telephone number are necessary to be able to deliver our communication to you.
b) Identification data
Above all, your username, password and photos for verification are important to us to make sure that we are really contacting the right person.
c) Data on the use of services
By using the Internet environment and logging in to the web interface of the application, you automatically send the IP address of your device. We can therefore detect the number of the network and subnet in which your device is located.
From the logs, which also record information about your activity in the application, the time of login, the actions you performed in the application, as well as information about the data filled in the forms for security reasons. We also record your interactions with other users, such as past contacts, your communications with users, and your user ratings. For optimal display of the application and services, we use information about your operating system (for example Windows, macOS, Android, iOS), its version and technical data about the devices from which you log in (for example, the type of your smartphone). However, we do not store most of this data about your system and equipment for a long time, nor are we able to connect it to your person without further data. The processing of all this data helps us to constantly improve our services and adapt them to your technical capabilities.
We further anonymize the above data on the use of services and use them for the further development of our services. However, after anonymization, we are no longer able to find out that this data is linked to your person.
d) Profile data
All data that you fill in to your profile, especially data about physical dispositions (eg height and weight), data on marital status, interests and education or your personal photos.
e) Geolocation data
This is data that identifies the coordinates (or address point) of a particular location. From the logs to the user account in the application, we subtract your frame location at login.
f) Information about interactions with us
In order to prevent us from contacting you more than once for the same reason, we record information about contacts between you and us. This is especially the data, such as the date (or time) of the contact, its reason, and whether the contact was initiated by yourself or us. This applies to contacts via all channels, especially via telephone, chat, mail, or e-mail.
g) Transaction data and order data
This is the information we obtain from you in connection with the purchase of paid services, such as your bank account number, the time and amount of the payment made, or details of the service provided, including its duration.
h) Data on sexual orientation and preferences
Information about your sexual orientation and preferences, which you voluntarily fill in your profile. Please note that if you provide this data other than in a place in your profile, we will not be able to distinguish it from other data and we will process it together with such data.
3) From what sources do we obtain personal data?
The personal data we process comes from you, and arises mainly from your registration in the application, your use of our services by you, your use of the application and our communication with you. We also obtain personal data directly from you by monitoring your behavior in the application.
4) Why do we process personal data and what entitles us to do so?
In the event that you register in the application, we process your personal data on the basis of your consent, fulfillment of the contract, our legitimate interest or due to fulfillment of a legal obligation for any of the specifically specified purposes of processing.
We process your personal data for the following purposes without your consent:
a) Enabling the use of the Services
Such processing of your personal data is necessary for the fulfillment of the contract, the subject of which is our obligation to provide you with our services. If you create an account in the application, we process your data, specifically contact information, identification data, data on the use of services, profile data, information on interactions with us and transaction data and order data based on the performance of the contract with you. Your personal data is made available to other users by viewing your user profile.
For this purpose, we process your personal data for the duration of the contractual relationship, ie for the period of your use of the application and until the termination of the contractual relationship and the cancellation of your user account.
b) Protection of our rights and interests
Such processing of your personal data, in particular contact data, identification data, service usage data, profile data, geolocation data, information on interactions with us and transaction data and order data is necessary for the purposes of our legitimate interests, namely the protection of our rights and interests (ie legal claims). For this purpose, we also process data on sexual orientation and preferences, for the processing of which you have given us consent or provided them when using the services, to the extent necessary to fulfill this purpose even after revoking the consent.
For this purpose, we process your personal data for a maximum period for the duration of the limitation period, including the period covering its possible suspension or interruption, but typically no longer than 16 years after the termination of the contractual relationship with you.
In the event of the initiation of judicial, administrative or other proceedings, we also process your personal data to the extent necessary for the entire duration of such proceedings for the purpose of enforcing and / or defending our legal claims.
c) Fulfillment of our legal obligations
Such processing of your personal data, specifically contact data, identification data and transaction data and order data is also necessary for the fulfillment of our legal (legal) obligations, especially legal obligations in the field of tax and accounting records. We too must fulfill certain statutory obligations. These are data that we primarily have to collect, evaluate and store for a specified period of time, because it is a fulfillment of our legal obligation. This is, for example, an archiving obligation under various laws governing the area of our business. For this purpose, we also process data on sexual orientation and preferences, for the processing of which you have given us consent or provided them when using the services, to the extent necessary to fulfill this purpose even after revoking the consent.
For these purposes, we process personal data for the period specified by the relevant legal regulations.
d) Promotion of the application and information about news
Such processing of your personal data, namely contact data, identification data, service usage data, geolocation data, information on interactions with us and transaction data and order data is necessary for the purposes of our legitimate interests in ensuring the promotion of the application to its users and information. users about news in the application, both unaddressed and addressed.
We process your personal data in this way, for example, when preparing and sending our information and promotional messages about the products and services we offer and optimizing offers directly in the application. Above all, information on the use of our services helps us to monitor and constantly improve their quality and maintain the favor of our users.
You can cancel the sending of information and promotional messages, which are sent to you electronically via e-mail and SMS, at any time and prohibit their further sending, via the link provided in each message sent in this way. In this case, these messages will no longer be sent to you.
For this purpose, we process your personal data for the duration of the contractual relationship and for the next three months after the termination of the contractual relationship, ie for the period of your use of the application and three following months from the termination of the contractual relationship and cancellation of your user account.
With your consent, we process your personal data for the following purposes:
a) Management and registration of data in the user profile
For this purpose, we process data on sexual orientation and preferences so that we can display this data in your profile. Your personal data is made available to other users by viewing your user profile.
You can revoke the consent to the processing of personal data for this purpose at any time. You will find more information and the procedure for revoking the consent in point 6) "Your rights in connection with the processing of personal data".
For this purpose, we process your personal data for the period of the granted consent, ie from the moment you give us consent, until the revocation of the consent or the termination of the contractual relationship and the cancellation of your user account.
5) Who processes your personal data and to whom do we pass it on?
Only Adentech employees who need them to manage the application and manage user profiles have access to your personal data.
Your personal data is not passed on to third parties, but is made available to other users during processing in order to enable the use of services and the management and registration of data in the user's profile.
In the event that we use the services of a third party as a processor for the processing of your personal data, this processing will be governed by a written contract concluded between us and this processor. This contract will contain all the requisites stipulated by law. Such processors are:
• Google
In cases stipulated by law, we are obliged to pass on your personal data to bodies active in criminal proceedings, or to other state administration bodies.
Your personal data is not transferred to a third country or international organization.
6) Your rights in connection with the processing of personal data
As users of the application, you have the following rights in relation to your personal data:
a) Withdrawal of consent
All consents we obtain are completely voluntary and you are not obliged to provide them. However, failure to grant or revoke consent will not affect the processing of personal data in accordance with other legal bases, including the sending of our business / marketing communications in accordance with our legitimate interests.
In all cases of consent-based processing, you can revoke it by following the procedure described in point 7) "How can individual rights be exercised?".
Withdrawal of consent does not affect the lawfulness of processing prior to such revocation.
b) Right of access to personal data
Simply put, you have the right to know what data we process about you, for what purpose, for how long, where we collect your personal data, to whom we transfer it, who processes it outside of us and what other rights you have related to the processing of your personal data. You can find all this in this document "Information on the processing of personal data". However, if you are not sure which personal data we are processing about you, you can ask us to confirm whether or not the personal data concerning you is being processed by us, and if so, you have the right to access this personal data. . As part of the right of access, you can ask us for a copy of the processed personal data, while we will provide you with the first copy free of charge and further copies with a fee.
c) The right to correct your personal data
If you find that your personal information is inaccurate or current, you have the right to ask us to correct it. In this case, we will make the correction without undue delay after you provide us with the correct personal data.
d) The right to delete your personal data
This right is also called the right to be forgotten. If you exercise this right with us, we are obliged to delete all your personal data, but only if one of the following conditions is met:
• Your personal data is no longer needed for the purposes for which it was collected or processed;
• you withdraw your consent on the basis of which the data was processed, and we will have no further legal reason to process your personal data;
• Your personal data will be processed illegally;
• Your personal data must be deleted in order for us to fulfill the obligation imposed on us by the law of the European Union or the Czech Republic.
Your personal data will not be deleted upon request, even if:
• we would be in breach of an obligation imposed on us by the law of the European Union or the Czech Republic;
• it is necessary for the exercise of our legal claims.
If the conditions for deleting your personal data are not met, we will inform you of this fact without undue delay and at the same time state the reasons why we cannot comply with your request.
e) The right to restrict the processing of your personal data
If you exercise this right with us, we are obliged to limit the processing of your personal data. However, we cannot always comply with this request, but only if any of the following reasons are met:
• if you believe that your personal data is inaccurate, we will limit the processing of your personal data until we verify this fact;
• if you believe that we are processing your personal data illegally and at the same time refuse to delete your personal data;
• We no longer need your personal data for processing, but to determine your possible legal claim;
• you have exercised the right to object to the processing of your personal data and it has not yet been decided whether our legitimate reasons for their processing prevail.
If the restriction requested by you is lifted, you will be notified in time.
f) The right to the portability of personal data
You have the right to obtain from us all your personal data that you have provided to us and that we process on the basis of your consent and on the basis of the performance of the contract. We will provide your personal data in a structured, commonly used and machine-readable format. In order for us to be able to easily transfer data at your request, it can only be data that we process automatically in our electronic databases.
g) Right to object
You have the right to object to the processing of personal data which occurs on the basis of our legitimate interest. In the case of marketing activities, we will stop processing your personal data without further ado; in other cases, we will do so unless we have compelling reasons to proceed with such processing.
h) The right to file a complaint
The exercise of rights in the above manner does not affect your right to file a complaint with the relevant supervisory authority. You can exercise this right in particular if you believe that we are processing your personal data unauthorizedly or in violation of generally binding legal regulations. 7) How can individual rights be exercised?
